FASD and mental capacity

Professionals are routinely carrying out mental capacity assessments under the Mental Capacity Act 2005 without any knowledge or understanding of FASD. This often leaves individuals with FASD vulnerable because their needs are not properly recognised and individuals do not get the help they need or are legally entitled to.

This project involves forming a working group to explore how to promote more understanding of mental capacity in individuals with FASD. We are working on resources to help the FASD community and those who work or care for individuals with FASD to understand how the Mental Capacity Act 2025 applies to those with FASD and to promote better practice.
